From Bob Scott today regarding that company that was being sued by Epicor:
Epicor Software has won a motion to name four employees of Alternative Technology Solutions as
defendants in a suit over copyright and intellectual property infringement. The U.S. District Court for the Central District of California
approved adding were Vivian Keena, CEO and Co-owner, and Donna Barnett, CTO and Co-owner, and employees, Ned Cleary and
Mark Stuvetraa, as individual defendants. Epicor is seeking actual and punitive damages from Alternative. Based in Aliso Viejo, Calif.,
ATS is a consulting firm that specializes in serving Epicor customers and most of its management worked at Epicor. Epicor obtained
an injunction against ATS in June 2013, alleging ATS illegally used or duplicated Epicor software to provide unauthorized consulting
and software customization services. The court also approved Epicor's adding additional claims, including violation of the Computer
Fraud and Abuse Act and violation of California Penal Code Section 502(c). Epicor filed the suit in the U.S. District court for the
Central District of California in March 2013 allege at Alternative, through its executives and employees, knowingly misappropriated
and misused Epicor's intellectual property and proprietary and confidential information. The suite or seeks the return of all of its
proprietary materials and intellectual property and to permanently enjoin Alternative's unauthorized and illegal activities and prevent
future violations. ATS defended itself and argued its work helps Epicor.
