  • 1.  Employee with Fraudulent Social Security Number

    Have a client with an employee who used a fake SSN to gain employment.  The employee worked part of 2018 and 2019 before this was discovered.  He does not have a valid SSN, and has been terminated.  My question is, what do we need to do for reporting his earnings for 2019?  What about a correcting W2c and W3c for 2018?  Aatrix will not file without a SSN.  Has anyone dealt with something like this before?  Any guidance appreciated.

    I would let the CPA guide you - unless that's you. in which case I don't know. There may be a potential liability for the company who paid the employee with the fake ID unless they followed all the I9 rules, etc. I typically give no advice in these situations but follow the CPA lead due to penalties the customer may receive.

    Ditto Wayne's comments.  We aren't in the business of advising on this type of reporting.  They should contact a CPA or a lawyer with this specialty or wait on hold for someone at the IRS. Sage makes our lives hard enough.  Don't need the mess associated to the IRS, immigration or some other government agency.
