  • 1.  Did Sage modify their EULA and remove mention of price hike limits?

    I can't find any mentions of price hike limitations in what I believe is Sage's most current EULA ( May 2020 ) - has it been removed or am I overlooking something?

    I believe you are correct @Wayne Schulz - I do not see any mention of it either.  Thank you for sharing this.  I didn't realize this had been updated.​​

    Good catch, Wayne. It's always had a clause that says it can be changed at any time.  So what's it's point in disclosing anything?  It's essentially a snapshot of the policy the day you signed, but Sage isn't held to it.  Kind of pointless in terms of Sage's obligations.  Only real teeth are the parts that the client has to agree to.

    My concern has always been that the EULA flashes by during upgrade time and in most cases, the VAR performing the upgrade is agreeing to bind the customer to whatever the EULA is at the moment. 

    I believe Sage should email the customer directly if there is a EULA change as well as an outline of the relevant changes.

    My concern is that the price hike limit is no longer valid.  could this be a case of "mere" oversight or a darker deed??  Did they eliminate lawyers in the most recent purge?  @Wayne Schulz - did you reach out for comment?

    The 10% max increase is indicated on the Sage 100C Order form.

    Maybe I have a different document somehow, yet in Section 14 it states the increase limit (please forgive the formatting, I can not paste it here without it changing).

      14. FEE INCREASES. Sage may increase its license and other fees at any time without notice so fees due for new or additional Software license or subscription purchases may be more than a previous purchase.
      a. If You purchased an On-Premise Subscription License, Sage may not increase On-Premise Subscription License fees more than once in any 12 month period following Your initial purchase by more than:

      (1) Ten percent (10%), or

      (2) The percentage increase in the unadjusted Consumer Price Index for All Urban Consumers (CPI-U) for the U.S. City Average for All Items, [1982]-[84]=100 (as published by the United States Bureau of Labor Statistics) for the 12 months preceding the date a price increase is announced for On-Premise Subscription Licensees generally, whichever is greater.

      Sage will notify You of a price increase at least 60 days before the increase takes effect.

      b. You are responsible for providing Sage with Your most current contact and billing information. You may provide updates to Your contact information to Sage at mailto:Subscriptionchanges@sage.comand updates to Your billing information to Sage at card.expirations@sage.com. You agree that, so long as Your On-Premise Subscription License is active, Sage may, on a monthly basis, automatically bill the same credit card or bank account You provide to Sage.

      Mine in 6.1 PU4 matches the online version. It may have been changed by PU.

      Certainly, the price increase limitation does not exist in either of those.

      We can't rely on anything in the EULA as permanent or binding anyway, since the agreement includes a clause saying that Sage can change any of the terms any time it wants to, but the other party can't.  Not quite sure how this basic undermining of contract law (value to each party) came to be common practice, but I'm pretty sure the quality of software would improve dramatically if this crap were to be ruled invalid, or at least had to be made reciprocal, so customers could say "Last year your software was worth $10,000 to me, but this year's model has no new features but lots of new bugs so I'm only paying you $3000".

      Putting together several announcements recently: Sage is now telling subscription customers that they will only give 30 days notice of price changes but also insist on having the customer give Sage 30 days notice on making changes to the subscription from their side?
      And judging from the November renewal amounts fiasco, they are still hoping they can ungrandfather as many subscription migrations as possible without anyone noticing.  Maybe I am attributing malice where simple incompetence will suffice, but persistent incompetence does get to seem like malice...
