Customer on 2016 Premium / SQL will upgrade to 2019 Premium / SQL. For v2016 they bought their SQL licenses from Sage and used that Sage provided SQL Server image. The Sage Application Server is on the same virtual machine (VM) and working fine for years. For v2019 upgrade, we do want to do a test upgrade for perhaps 30 - 45 days until go live. To that end, they will spin up a new VM for the new SQL and App Server.

The question is on the 2019 VM can they install with same Sage provided SQL Server image they already have for 2016 (which has the Sage OEM SQL product key burned in) for test upgrade while they continue to run 2016 live (they will eventually shut down the 2016 VM and that SQL Server instance)

    OR

Will it phone home to a Microsoft entitlement server and prevent it? If it does allow installation, will it phone home later and stop working after X number of days?

There is also issue of whether the o/s for 2019 VM will be compatible with the Sage provided SQL Server version. I will figure that out but let's assume it's compatible. Also, this is entirely an on-premise upgrade both 2016 and 2019 sides. No hosting, no data center, no AWS cloud, no Azure cloud, etc, ergo no licensing violation to consider for using the Sage OEM version of SQL Server in a hosted environment.

Legally, it's gray as usually you need Software Assurance to have hot-spare rights (though cold-spare is normally OK). There might be specific verbiage in the EULA for this scenario.  Realistically, SQL Server licensing is on the honor system, there's no phone home mechanism, and I would argue that only one of those servers is in Production at any given time (the other is Test/Train).

SQL Server 2014 works/is supported on Windows Server 2016.  I haven't tried Server 2019, though I would guess it would work as well.
